SAYA merupakan salah seorang pelanggan Agrobank yang membuat pembiayaan peribadi islamik dengan bank berkenaan. Saya ingin menyampaikan rasa tidak puas hati saya berkenaan kadar caj penalti yang dikenakan oleh Agrobank kepada pelanggannya yang menyelesaikan pinjaman lebih awal jika makluman berkenaan penyelesaian tidak mencukupi 3 bulan.
Pada bulan November 2009 saya telah mengemukakan pertanyaan berkenaan baki pinjaman yang perlu dilangsaikan jika saya ingin menyelesaikannya lebih awal dan saya sangat terperanjat apabila dimaklumkan akan ada caj penalti sebanyak 30 peratus daripada jumlah rebat jika pinjaman berkenaan diselesaikan kurang daripada 3 bulan dari tempoh notis.
Untuk mendapatkan kepastian, saya telah menghubungi pihak Cawangan Utama dan pengesahan semula telah dilakukan di cawangan yang berdekatan. Terbukti memang caj berkenaan dikenakan kepada mana-mana pelanggan yang tidak memberikan 3 bulan notis ataupun notis yang dikemukakan kurang 3 bulan.
Makluman berkenaan caj berkenaan hanya berada di bank sahaja dan bukannya berada di dalam dokumen perjanjian.
Saya secara sinisnya pernah ditegur oleh salah seorang pegawai bank agar menyelesaikan pinjaman selepas 3 bulan surat berkenaan bagi mengelakkan dikenakan caj 30 peratus itu.
Sebagai pelanggan, saya faham pihak bank akan mengalami gangguan margin disebabkan tindakan penyelesaian awal saya ini dan mereka berhak mengenakan sedikit penalti untuk menampung kos berkenaan.
Namun apa yang menghairankan saya adalah nilai caj 30 peratus berkenaan adalah terlalu besar dan seolah-olah rebat atau ibra'yang diberikan kepada pelanggan ditarik balik sebahagiannya.
Pengalaman membuat pinjaman secara islamik sebelum ini juga menunjukkan bahawa di dalam dokumen perjanjian akan dinyatakan secara khusus caj penalti berkenaan bagi kes penyelesaian tanpa notis 3 bulan samada dalam bentuk caj sekitar 1 hingga 5 peratus ataupun gantian 3 bulan notis.
Ini mengakibatkan saya menjadi keliru dan rasa tertipu kerana bank boleh mengolah apa sahaja terma kerana ianya memang tiada di dalam perjanjian. Aduan telah dikemukakan dan dikatakan perkara ini akan dibincangkan di peringkat yang lebih tinggi.
Namun sehingga hari ini belum ada sebarang berita yang diterima kecuali emel makluman sahaja.
Mungkin bagi sesetengah orang nilai caj berkenaan tidak seberapa, tapi cuba bayangkan kalau jumlah rebet berkenaan contohnya RM 50,000; penaltinya sahaja mencecah RM 15,000 seolah-olah membayar faedah seperti meminjam dengan ahlong.
Perkara sebegini jika diteliti akan mengakibatkan pelanggan-pelanggan akan hilang kepercayaan kepada Bankdan juga secara tidak langsung hilang kepercayaan kepada sistem perbankan Islam yang sepatutnya tiada unsur keraguan atau gharar.

Kerajaan harus mengetatkan pengawasan terhadap bank terutamanya yang bukan full fledge Islam seperti agrobank ini. Jika benar, BNM harus masuk campur supaya golongan kapitalis ini tidak terus-terusan menghisap darah pengguna.

60 lose RM25mil in gold investment scam in Penang

At least 60 people from Penang have lost more than RM25mil in a gold investment scam which is said to be operated by a Kuala Lumpur-based company.
Police believe that the amount of money and the number of victims are just the tip of the iceberg as there could be many cases which have gone unreported.
State Commercial Crime Investigations Department chief Asst Comm Roslee Chik said 30 reports involving 60 victims were received this year. All the incidents took place last year.
He said the Bukit Aman police headquarters had since taken over the investigation as the duped investors are from all over the country, including Kuala Lumpur and Selangor.
He added that the victims only realised that they were taken for a ride in the fourth month of investment.
“This is when the syndicate would give them two options – either to renew the contract or to pull out from the scheme.
“It would be the end of the road for investors then. For either options, syndicate members would tell you they need to re-weigh and re-assess the genuineness of the gold bars which was given to the investors.
“The syndicate will claim they need seven days to check the gold bars. But during the period, they will abscond with the gold,” ACP Roslee said at a press conference at the state police contingent headquarters yesterday.

It's much much safer to buy gold straight away rather than investing something unreal that they so called "gold account".

Jangan samakan intan dan kaca
1. The rejection of fiat money is not only because of the system itself. It's more than that. I have spoken about this a year ago in this blog. You may read here. Some of us may thought if the system could be treated correctly, whatever monies (either fiat or commodity) used could be a medium of transaction. I think let's we take a look at a glance of history of financial system before we could agree.
2. By looking back to history (in 1920's), we found the system was superb and tremendously excellent which was gold to be kept in a secure vault and only a piece of guaranteed and redeemable paper to be practiced during transaction.
3.General idea is good but due to the regulation of the system was human made; weaknesses easily occurred. The 'self-temptation' of ordinary man suddenly was appeared (bad deeds and behaviour such as greedy, power craziness etc are among the biggest one) and started to conquer and disturb the rationality of human, thus, leads to a failure in 1970's. It is an excellent at the beginning but not the ending. That's how the past was telling us. Should we create another failure in the future?
4.People can't be able to make themselves sustainably good in all time. Allah knows better His creature. The gold and silver are likely to be a self guidance in financial sector and automatically remove the unnecessary interruption made by man directly or indirectly; intentionally or unintentionally. The history's evidence told us that people-money relation are always irregular among each other.
5. Every creature created by Allah is not useless. The gold and silver treasured under the ground is not for nothing.
